1. Who We Are and What This Covers

This Privacy Policy describes how we handle information collected through bartletthicksrealty.com (the “Site”).

The Site is operated by HDMS & Standard GIS, Inc., an Arkansas corporation. Real estate brokerage services are offered under the firm name Bartlett Hicks Realty, Inc., the firm name approved by the Arkansas Real Estate Commission. In this Policy, “we,” “us,” and “our” refer to that business.

This Policy covers the Site only. It does not cover the other lines of business the corporation conducts under other names, and it does not cover websites operated by anyone else.

We have written this Policy to describe what we actually do. If something here is wrong, tell us at the address in Section 18 and we will fix it.

2. Information You Give Us

We collect this only when you choose to provide it:

  • Name, email address, and phone number, when you contact us, submit an inquiry, or create an account.
  • What you tell us about your property or your search — address, acreage, condition, timeline, price expectations, and anything else you write in a message to us.
  • Account information, if you create an account: your login credentials, a profile picture — either one you upload or the one associated with the account you sign in with — and the searches and properties you save.
  • Documents and photographs you send us in connection with a listing or a transaction.

Signing in with Google. Google Sign-In is used strictly to authenticate you and to manage your account — your saved searches, favorite properties, and preferences. If you choose to sign in with Google, we receive your name, email address, and profile picture from your Google account in order to create and identify your account. We never receive your Google password, and we do not access your Gmail, Drive, Contacts, Calendar, or any other Google service. You can disconnect our access at any time from your Google Account permissions page at myaccount.google.com/permissions.

Signing in with Google is optional. You can create an account with an email address and password instead.

We do not process payments on the Site and do not collect payment card information.

3. Information Collected Automatically

When you use the Site, our analytics provider records:

  • Pages you view and how long you stay, including the address of the page, the page you came from, and the site that referred you.
  • Which property listings you view and, if you have an account, which listings you save and unsave.
  • Which search filters you use. We record that a filter was changed — not the value you set it to, and not the text of anything you type into a search box.
  • Where visitors click and tap, as aggregated heat maps showing which parts of a page get attention.
  • Your device and connection: IP address, browser and version, operating system, device type, screen and window size, time zone, and browser language. IP addresses are stored in full for the retention period stated in Section 12.
  • Technical diagnostics: page performance measurements and error reports generated when something on the Site malfunctions, used to find and fix problems.

This activity is recorded under a temporary identifier that lasts only for your visit. Our analytics stores nothing on your device (see Section 4), so it cannot recognize you when you come back — a returning visitor looks like a new one. Actions that require an account — saving a search, favoriting a property, signing up — are recorded under your account’s internal identifier, not your name or email address. We do not build named profiles of visitors in our analytics.

What we do not do. We want to be specific about this, because these practices are common and we have chosen against them:

  • We do not record your screen. We do not use session replay, which captures a video-like recording of everything a visitor does on a page.
  • We do not run advertising or marketing trackers. There is no advertising pixel, no retargeting tag, and no cross-site advertising network on this Site.
  • We do not sell your information, and we do not share it for cross-context behavioral advertising.

4. Cookies and Similar Technologies

The Site uses cookies for one purpose: signing you in and keeping you signed in to your account. Those cookies are required for sign-in to work and are not used to track your browsing.

Our analytics sets no cookies and stores nothing on your browser or device. It distinguishes one visitor from another by a temporary identifier that is discarded when you leave, which is why it cannot recognize a returning visitor.

Most browsers accept cookies by default and let you refuse them in settings. If you refuse them, you can still browse listings, but creating an account and staying signed in will not work.

5. How We Use This Information

  • To answer your inquiry and provide the brokerage services you asked for.
  • To operate your account and keep your saved searches and favorites available.
  • To show you property information and to improve how the Site presents it.
  • To understand which listings and pages are useful, and to find and fix problems.
  • To send you the notices and communications described in Sections 8 and 9.
  • To meet our obligations under Arkansas real estate license law and other applicable law.
  • To protect the Site against fraud, abuse, and unauthorized access.

We do not use your information to make automated decisions about whether to work with you.

6. Who Receives Your Information

We do not sell, rent, or lease your information to anyone.

We use a small number of service providers to run the Site. Each receives only what it needs, is contractually restricted to providing services to us, and may not use your information for its own purposes:

  • Vercel hosts the Site and processes requests, including IP addresses, in server logs.
  • Neon hosts our database, where accounts, saved searches, favorites, and inquiries are stored.
  • PostHog provides the analytics described in Section 3.
  • Resend sends our email, including confirmations and notifications.
  • UploadThing stores profile pictures and other files you upload.
  • Upstash provides the rate limiting that protects our forms and sign-in against abuse, which involves processing IP addresses.
  • Inngest runs scheduled background work for the Site, such as sending the email described in Section 9.
  • Google Workspace runs email for our bartletthicksrealty.com addresses, where messages you send us — including inquiries and privacy requests — are delivered and stored.
  • Google Sign-In authenticates people who choose to sign in with a Google account.
  • Microsoft 365 runs email for our hdmsarch.com addresses, including the legal and copyright contacts published in our Terms and Conditions.

In a transaction. If you list a property with us or buy through us, we share information as necessary with the parties to that transaction — which may include the other side’s brokerage, a title company, a lender, an appraiser, an inspector, a surveyor, and an attorney. Section 7 covers the multiple listing service separately.

When the law requires it. We may disclose information without notice where we believe in good faith that it is necessary to comply with law or legal process, to protect our rights or property, or to protect the safety of any person.

If the business changes hands. If the business is sold or merged, information may transfer with it, subject to this Policy.

7. Property Listings and the Multiple Listing Service

This section matters most if you list a property with us, and it describes a flow people are often surprised by.

Listing information you give us is published widely and is not private. When your property is listed, its details, photographs, and related materials are submitted to Cooperative Arkansas REALTORS® Multiple Listing Services, Inc. and distributed from there to member brokerages and to public listing portals. That material may be copied, cached, and retained by those recipients indefinitely, including after your listing is withdrawn, expires, or sells. We cannot retrieve or delete it from them. If there is something you do not want published, tell us before the listing goes live.

Your MLS may offer options to limit internet display of your listing, to disable third-party comments, or to suppress automated valuation estimates. Ask us and we will explain what is available.

Listing data we display from other brokerages is provided to us under an Internet Data Exchange license. Browsing those listings on our Site does not send your information to the MLS or to the listing brokerage — the data flows to us, not from you to them. If you submit an inquiry about another brokerage’s listing, we may need to contact that brokerage on your behalf, and we will tell you when that happens.

8. Calls and Text Messages

If you give us your phone number, we may contact you at it about your inquiry or your transaction.

Consent to receive marketing calls or text messages is asked for separately, at the form where you provide the number, and it is never a condition of buying or selling property with us or of using the Site.

You may revoke that consent at any time by any reasonable means — replying STOP to a text, telling any of our licensees, or writing to us at the address in Section 18. We will honor a revocation within ten business days. Message and data rates may apply.

9. Email

We may email you about your inquiry, your account, or your transaction. We may also send occasional announcements about our listings and services.

We do not track our email. Our email provider supports recording when a message is opened and when a link in it is clicked; we have both features turned off.

You can stop marketing email at any time using the unsubscribe link in any such message, or by writing to us at the address in Section 18. We will still send messages necessary to your account or to a transaction you are part of.

10. Your Choices

Write to us at the address in Section 18 and we will, within a reasonable time and at no charge:

  • Tell you what personal information we hold about you.
  • Correct anything that is wrong.
  • Delete your information, subject to the limits below.
  • Close your account and remove your saved searches and favorites.
  • Stop marketing email, calls, and texts.
  • Disconnect Google Sign-In at myaccount.google.com/permissions. Doing so ends Google’s role in signing you in; it does not by itself delete the account you created here.

Limits on deletion. We cannot delete everything on request, and we would rather say so than promise otherwise:

  • Transaction records. Arkansas real estate license law requires us to retain records of transactions for a set period. We cannot delete those records before that period ends.
  • Published listing data. As explained in Section 7, we cannot recall listing information already distributed to the MLS and to listing portals.
  • Legal obligations. We retain what we must to comply with law, resolve disputes, and enforce agreements.

We do not charge for these requests and we will not treat you differently for making one.

11. Do Not Track and Global Privacy Control

Some browsers can send a “Do Not Track” signal or a Global Privacy Control signal. There is no common industry standard for how sites should respond to them. At this time we do not respond to Do Not Track signals. We disclose this so you can decide accordingly. We do not sell personal information or share it for cross-context behavioral advertising, so a Global Privacy Control signal would not change what we do with your data.

12. How Long We Keep Things

  • Analytics data described in Section 3: retained by our analytics provider for twelve months, then deleted.
  • Inquiries and correspondence: kept while we are working with you and for a reasonable period afterward.
  • Account information: kept until you close your account.
  • Transaction records: kept for the period Arkansas real estate license law requires.

13. Security

We maintain administrative, technical, and physical safeguards intended to protect personal information from unauthorized access, acquisition, disclosure, or use — including encryption of data in transit using TLS, access controls limiting who can reach lead and account information, and contractual security obligations on the service providers listed in Section 6.

No system is perfectly secure, and no transmission over the internet can be guaranteed. We do not claim otherwise. What we do claim is that we take this seriously and that we will tell you promptly if something goes wrong.

14. If There Is a Data Breach

If personal information is acquired without authorization, we will investigate promptly and notify affected individuals in the most expedient time and manner possible, consistent with the Arkansas Personal Information Protection Act, Ark. Code Ann. §§ 4-110-101 through 4-110-108, and any other law that applies. Where that Act requires it, we will also notify the Arkansas Attorney General.

15. Adults Only

The Site is intended for adults. We do not knowingly collect personal information from anyone under eighteen. If you are under eighteen, please do not create an account or send us information. If you believe someone under eighteen has given us personal information, contact us at the address in Section 18 and we will delete it.

16. Other Websites

The Site links to websites we do not operate, including listing portals and the websites of other businesses. We are not responsible for their content or their privacy practices. When you leave our Site, read the policy of the site you land on.

17. Changes to This Policy

We may update this Policy — when the Site changes, when our practices change, or when the law changes. The version in effect is the one posted here, and it carries the effective date shown at the top.

If we make a material change, we will update that date and, if you hold an account, notify you by email or through the Site before the change takes effect.
